UAE supplement

This is Crewla's Self-Billing Agreement for work that takes place in the United Arab Emirates (UAE). It consists of this supplement and the general agreement below; where the two differ, this supplement prevails.

Who issues the document

For work in the UAE the document for your earnings is a self-billed invoice issued on your behalf by Crewla's EU company: [PLACEHOLDER: EU company (proposed Estonian OÜ) — name, VAT number and address once incorporated], under Article 224 of the VAT Directive (2006/112/EC). The Turkish documents in section 2 of the general agreement (expense voucher, e-Archive) are not issued for this work.

Amounts and VAT

  • The document is in UAE dirhams (AED), one per booking, for your earnings (your rate minus the commission). You accept this agreement with your tax profile, which names you by your Emirates ID number.
  • If you are registered for UAE VAT (registration is mandatory above AED 375,000 of taxable supplies a year), tell us through support with your Tax Registration Number (TRN) before your next job; the document then shows UAE VAT. Otherwise it shows none.
  • The UAE has no personal income tax; any tax on your income in the country where you are tax resident remains yours to declare.

Language

This agreement is published in English, with its title also in Arabic; an Arabic text (and a right-to-left layout for it) is an open question.

The general Self-Billing Agreement follows.

1. What this agreement allows

On Crewla you sell your service to Crewla, and Crewla sells it to the customer (see the Worker Service Agreement). Crewla needs a purchase document for the service it buys from you. With this agreement you allow Crewla to issue that document on your behalf. This is called self-billing.

That way the right document is issued for every job even if you have no company or invoicing software, and you do not have to issue an invoice yourself.

The document is issued by the Crewla company that buys the service in the market where the work is done:

  • Work in Turkey by a worker in Turkey: Nivorbit Teknoloji Limited Şirketi (Çanakkale Tax Office 6311513136).
  • All other work: [PLACEHOLDER: the EU company's name, VAT number and address — added once it is incorporated].

2. Which document is issued?

The document type follows the status you choose in your tax profile.

Your statusDocument issued in Turkey
Individual, not a taxpayerNivorbit Teknoloji issues an expense voucher (gider pusulası) for you.
Sole proprietor (self-employed or tradesperson)Crewla issues an invoice in your name with your details (e-Archive / e-Invoice or e-SMM, depending on your status).
Company (limited or joint-stock)Crewla issues an invoice in your company's name with its details.

If you are VAT-registered you say so in your tax profile, and the document's VAT is calculated accordingly.

Income tax withholding: where the law requires it, Crewla withholds income tax from the amount on the expense voucher and pays it to the tax office on your behalf; the withholding shows as a separate line on your earnings statement. Withholding is a rule per market. In Turkey its rate and base will be settled with the accountant's approval; until then no withholding is applied.

Work through the EU company: the EU company issues self-billed invoices on your behalf in line with Article 224 of the VAT Directive (2006/112/EC). That article requires a prior agreement between the parties and a procedure for accepting each document; this agreement and section 5 below exist for that purpose. [PLACEHOLDER: details for the EU company's country, such as invoice numbering, language and the "self-billing" mention]

3. What the document shows

Each document covers the earnings of one booking and shows: the document number and date, your name or company name, your tax number (for an individual, the Turkish identity number), the tax office for sole proprietors and companies, the description and date of the service, the amount, and any VAT and withholding. The emergency premium for work you completed as a stand-in is part of your earnings.

Your tax number is stored encrypted, and only its last four digits are ever shown on screen.

4. Your duties

  • Give correct details. The details in your tax profile (status, tax number, tax office, legal name, VAT registration) must be correct. You are responsible for the tax consequences of wrong details.
  • Report changes. Update your tax profile as soon as you open or close a business or your VAT status changes. New details apply to documents from then on.
  • No second document. Do not issue your own invoice, e-SMM or any other document for earnings Crewla has already documented on your behalf. Documenting the same earnings twice causes tax problems.
  • File your own return. These documents do not replace your duty to declare your income; your income tax return and other obligations remain yours.

5. Checking documents and objecting

Every document issued appears in your account and can be downloaded. If you see a mistake, report it through support within [PLACEHOLDER: period] days of the document date. If you do not object within that period, the document is deemed accepted. If your objection is justified, Crewla corrects the document by the proper legal procedure, or cancels it and issues a new one.

You give consent on the screen where you save your tax profile. Consent is asked for every time you save, and is stored with the version of this agreement you accepted (currently 1.0) and the time. A tax profile cannot be saved without consent, and earnings cannot be paid without a tax profile.

7. Agency work is outside this agreement

For work you do from a supplier agency's roster, payment goes to the agency and the agency invoices Crewla itself. Crewla issues no documents on your behalf for that work.

8. Keeping the documents

Documents are kept for 10 years from the end of the year they were issued in (Turkish Commercial Code art. 82, Tax Procedure Law art. 253). They are stored so that they cannot be altered and remain for that period even if you delete your account. Your tax profile is kept for 10 years after your account is anonymised and then deleted. Details are in the Privacy Policy.

9. Ending the agreement

  • To withdraw your consent, tell us through support. Once withdrawn, no new documents can be issued on your behalf, so new payouts wait until another way of documenting them is agreed (for example, uploading your own invoice). [PLACEHOLDER: a way to upload your own invoice — product decision]
  • The agreement ends when your account closes; documents for work completed before then are still issued.
  • Ending the agreement does not affect documents already issued.

10. Changes

When this agreement changes, a new version is published and you accept it the next time you save your tax profile. We announce significant changes that alter the document type in advance.
